By opening and using the FAM app, you have volunteered and lent your consent to participating in a fitness program provided by FAM and its designated staff and trainers. The fitness programs provided by FAM include but are not limited to aerobics, resistance training, cardiovascular exercise, yoga, and balance, et al. In consideration of this agreement and my use of the FAM App, I do here now and forever release and discharge and hold harmless FAM, its staff and trainers and their respective heirs, assigns, agents, contractors and employees for any and all claims, rights of action, damages, demands, or causes of action, present or future, arising out of or connected with my participation in any FAM exercise or instructional regiment, including any injuries resulting there from.
By opening and using the FAM app, you acknowledge that you have been advised by this notice that you should obtain a physical examination or receive medical advice with respect to commencing a fitness and/or exercise program or engaging in any strenuous activity or activity outside of your normal activities performed, to include the FAM App.
If you have chosen to engage with the FAM App without obtaining a physician’s consent or advice prior to doing any activity associated with this App, you agree that you are doing so solely at your own risk, and acknowledge and agree that the assumption of the risks associated with any and all activities, fitness regimens, instructions or any related activities is assumed by you and you alone prior to participation.
By participating in the FAM App after reading these Terms & Conditions, I fully acknowledge and understand that I release FAM and its designated staff and trainers of any and all liability; and that I am waiving any right I or my successors may have to assert a claim or bring any legal action against FAM for your negligence or that of your employees.
